DB 16-219 Department General Order 5.01, "Use of Force" Update Packet #54
Department Notice
The purpose of this directive is to announce the Police Commission's adoption of revised Department -General Order 5.01, Use of Force, effective December 21, 2016. The operative date of this new DGO 5.01 is December 27, 2016.
This order contains significant updates to the Department's Use of Force policy, of which I call to your attention to the following:
- Prohibition on shooting at moving vehicles and
- Prohibition on the use of the carotid restraint.
These sections read as follows:
Section VI.B.3.
PROHIBITED USE OF CONTROL HOLDS. Officers are prohibited from using the following control holds:
a. carotid restraint ...
and,
Section VI.G.2.e:
MOVING VEHICLES. An officer shall not discharge a firearm at the operator or occupant of a moving vehicle unless the operator or occupant poses an immediate threat of death or serious bodily injury to the public or an officer by means other than the vehicle. Officers shall not discharge a firearm from his or her moving vehicle.
Members shall immediately familiarize themselves with all the requirements of this new use of force policy. The Department is committed to providing foundational and ongoing training to all officers on the new Use of Force policy. The foundational training for all current officers will be conducted on a rolling basis and should be completed within six months.
