24-149 Department General Order 5.06 "Citation Release" Update Packet #115
Department Notice
The purpose of this directive is to announce the revision of Department General Order 5.06 Citation Release, adopted by the Police Commission on September 4, 2024. Members will be held accountable for this policy starting Saturday, October 19, 2024.
The major updates in this policy include, but are not limited to the following:
5.06.02 Policy
- Section A. General - Updated to include Cal. Penal Code section 853.6(g).
- Section B. Misdemeanor Exceptions- The list of conditions requiring a custodial arrest rather than a citation release have been revised in its entirety.
- Section D. Decision to Cite - The language relating to Private Persons Arrest has been removed.
5.06.03 Procedures
- Section B. Citing Juveniles - All content was removed and replaced with a reference to DGO 7.01 Policies and Procedures for Youth Non-Psychological Detention, Arrest and Custody.
Lieutenants, sergeants, and training coordinators should read, review, and discuss this policy during line-ups.
Members are expected to have a working knowledge of all directives applicable to their respective assignment and comply with their provisions, per DGO 3.01, Department Written Directives. Members shall obey all written orders, policies, and procedures of the Department, per DGO 2.0 I, General Rules of Conduct.
