SFPD Arrests Prolific Shoplifter Under New Theft Law 25-071

On May 25, 2025, Neil Peck aka Kevin Peck (51-year-old male) was arrested for a burglary and attempted grand theft incident at a retail store on the 700-block of Mission St. An astute patrol officer discovered that Peck was a suspect in dozens of other thefts from the same store and notified investigators with the SFPD Defend Against Retail Theft (DART) Organized Retail Crime (ORC) Task Force.

On December 18, 2024, Proposition 36 came into effect after being passed by voters. Proposition 36 included the creation of CA Penal Code 666.1. This statute enables the charging of petty theft incidents as a wobbler (misdemeanor or felony) if the suspect has two or more prior theft convictions. Peck had numerous prior theft convictions.

SFPD DART investigators began investigating Peck for the prior theft incidents and determined that he was the suspect in 16 additional chargeable cases from October 7, 2024, to May 22, 2025. The total loss for the incidents totaled nearly $8,000.

As of May 29, 2025, Neil Peck was still in custody for the May 25, 2025, incident. After consultation with the San Francisco District Attorney's Office Organized Retail Theft prosecutor, Peck was arrested on the following charges:

  • 16 x Petty Theft w/ Prior - 666.1(a)(1) PC/Felony
  • 1 x Commercial Burglary - 459 PC (2nd degree)/ Felony
  • 1 x Grand Theft - 487(a) PC/ Felony
  • 1 x Shoplifting - 459.5(a) PC/Misdemeanor
