Training Division Refresher Course Following OIS and Other Serious Incidents

I. PURPOSE

The purpose of this order is to set a policy to conduct a Training Division Refresher Course when deemed appropriate by the Chief of Police.

II. POLICY

The Training Division is tasked with conducting the refresher course for Department members. The Field Tactics Force Options Unit provides training oversight, consistency, and guidance with respect to the application of field tactics and force options by sworn members.

This Training Division Refresher Course is not an incident tactical debrief.

All Department training is considered a developmental tool.

III. PROCEDURE

The Risk Management Office (RMO) is tasked with identifying "primary involved members." The RMO shall use the following criteria in making this determination:

• An Officer-Involved Shooting: The officer who discharged their firearm with or without physical injury or death of a person, or an unintentional discharge that results in physical injury or death.
• An In-Custody Death: The officer(s) who utilizes physical restraints and/or any use of force as defined by SFPD policy, any officer(s) who detained or confined a subject in an SFPD vehicle or any officer(s) responsible for maintaining custody or control of a subject during a detention or confinement in a jail or detention facility.
• A Designated Use of Force: The officer(s) who uses force that results in injury that requires admission to the hospital or upon a SFPD supervisory evaluation that indicates that the officer(s) use of force appears unreasonable and resulted in serious bodily injury.

The involved member(s)' Commanding Officer will identify all "substantially involved members." The following criteria will be used in determining a "substantially involved member":

• Those officer(s) who were immediately present at the scene, such as a partner officer.
• Officer(s) who responded as back-up to the incident, or an officer who observed the incident and/or activities that preceded it.
• Members who used force or had a significant tactical or decision-making role in the incident.
• A member who is subject to criminal and/or administrative review as a result of the incident. 
• The platoon commander and/or the members' immeadiate supervisor shall be considered a "substantially involved member."

Officers who respond to the scene after the incident occurred and participate in crime scene management, command post management, crime scene logs etc. do not fit into this category.

Department members who have been identified as "primary involved" or "substantially involved" in an incident shall be detailed to the Training Division for a 1-day Refresher Course within 30 calendar days of the incident date.

The FTFO Refresher Course shall be comprised of seven mandated topics:

• Use of Force Policy / Use of Deadly Force
• Command and Control
• Tactical Communication
• Tactical Planning
• De-Escalation Techniques
• Firearms and other Equipment
• Safeguarding human life and dignity (Sanctity of Life)

Additional topics may be covered at the discretion of the Risk Management Office and/or Training Division. Examples may include arrest and control. EVOC, etc.

If during this training the FTFO staff identifies an area where further training would be beneficial to the officer or officers, the FTFO staff will note the recommended training on their training report to the Risk Management Office. Once the training report is reviewed and approved, the Risk Management Office and Training Division will coordinate completion of the recommended training with the member or member's Commanding Officer.

IV. ADMINISTRATION

The Commanding Officer of the primary involved and substantially involved members shall ensure that the unit's training sergeant coordinates with the FTFO staff, to have the training scheduled within 30 calendar days of the incident date.

The members attending shall be carried in HRMS as their home assignment, shift 5, with "Training Division Refresher Course" in the comment section.

If further training is recommended, the Risk Management office will notify the members' Commanding Officer and the FTFO staff. The training should take place with all deliberate speed.

V. REPORTING

The Training Division shall maintain the training records of members in attendance at the Refresher Course. The training record will memorialize the topics covered in the course. Since specific actions by members related to the OIS or serious incident will not be discussed in any manner during the course, the training record will not contain these details. The Training Division will also send a record of this training to the member's Commanding Officer.
