26-016 Mobile Fingerprint Identification (Mobile ID)
Department Notice
The Department will be expanding the release of the Evolution 3 device, mobile fingerprint identification system (Mobile ID). Members may request the use of the device via Dispatch once devices become available.
Authorized Use:
Mobile ID shall only be used during the course of a member's lawful duties and one of the following circumstances exists:
- The member has probable cause to believe the individual has committed a crime.
- The member has detained an individual based on a reasonable suspicion that they have a warrant and need to verify identity.
- The member has detained an individual under W &I 5150 and need to make an identification.
- The detained individual is in custody and the member needs confirmation of identification for transportation.
- The member has asked for consent to verify the identity of a reported missing person.
- The individual is unable to provide reliable identification due to physical incapacitation or defect, mental incapacitation or defect, or death, and immediate identification is needed to assist the member in performance of their lawful duties. The member shall not use the Evolution device to identify a person for purposes of certification of death.
- Pursuant to a valid court order.
Identification Process:
Fingerprint images are electronically transmitted to the SFPD Automated Fingerprint Identification System (AFIS), Cal-ID AFIS, and FBI Repository for Individuals of Special Concern (RISC) databases where a non-assisted fingerprint search is performed. The captured
fingerprint images are not retained on the Scanner. One of the following responses is returned to the member via the Evolution device:
- "Hit" -This response means an identification match was made. An individual's name, date of birth, SF number, CII number, FBI number and possible mug shot photo may be returned.
- "No Record was Returned" -This response means no identification match was made.
- "Unable to Determine" - This response means possible candidates were found, but the scoring of such identifying fingerprints is below a defined criteria threshold used to confirm a positive "Hit" without human intervention.
Individual Mobile ID "Hits" are limited to individuals maintained in the SFPD AFIS, Cal-ID AFIS, and FBI RISC databases. Records may exist in other biometric or name-based repositories.
If the results have not returned by completion of the field investigation, the person must be released or taken to a police facility for identification.
Disclosure and Use of Information:
- The information contained in a Mobile ID response may contain Personally Identifiable Information (PII) or Criminal Justice Information (CJI) which is considered "controlled and need-to-know" information.
- Members shall follow the outlined authorized uses.
Documentation:
All Mobile ID use will require articulable reasons before submitting any fingerprints as a part of the system audit trail (including use of Mobile ID to assist another law enforcement agency) and shall be documented in an incident report (if an incident report is being completed), BWC, or CAD.
At a minimum, the documentation shall include the date, time, location, and justification for utilizing Mobile ID.
Auditing and Penalties for Misuse:
All Mobile ID use is subject to audit. Improper access, use, or dissemination of PII or CJI obtained from use of Mobile ID by members may result in removal of member's access, administrative sanctions, and/or criminal penalties.
