Penal Code 13652.1

Penal Code 13652.1 requires the department to include the following information that was known at the time of the incident:

  1. A description of the assembly, protest, demonstration, or incident, including the approximate crowd size and the number of officers involved.

  2. The type of kinetic energy projectile or chemical agent deployed.

  3. The number of rounds or quantity of chemical agent dispersed as applicable.

  4. The number of documented injuries as a result of the kinetic energy projectile or chemical agent deployment.

  5. The justification for using the kinetic energy projectile or chemical agent, including any de-escalation tactics or protocols and other measures that were taken at the time of the event to de-escalate tensions and avoid the necessity of using the kinetic energy projectile or chemical agent.

On March 2, 2024, SFPD officers were deployed to the Embarcadero Plaza in the City and County of San Francisco for the "Millions March for Palestine" event. The event was unpermitted. Approximately 1500 people came to the event, which eventually marched to the Consulate General of Israel (456 Montgomery St), taking over Market, Kearny, Clay, and Montgomery streets while en route.  Only approximately 30 officers were deployed to the event. During the march, protesters in the crowd vandalized numerous locations of every block with fresh graffiti.  Because of the small contingent of officers, the 400 block of Montgomery St was barricaded to prevent further vandalism and the possibility of a breach of the Consulate. While at the 400-blk of Montgomery St the crowd became unruly and unlatched some of the barricades, violently using them to push towards the officers on the opposite side to try to breach through the line.  Numerous commands were given to the protestors, ordering them to stop and get back.  Protesters also began to throw bottles, ink/paint containers, punches, and spit at the officers.  An SFPD member deployed their department-issued oleoresin capsicum (OC) spray at three of these offending protestors. The OC spray was deployed to overcome the resistance of the assaultive protestors, to prevent further commission of public offenses, to defend against serious bodily injury to them and other officers, and to gain compliance with a lawful order. There were no documented injuries as a result of the OC spray deployment.

On June 16, 2022, officers were in the area of 24th St and Harrison St regarding large crowds celebrating the Warriors winning the NBA Finals. At approximately 0004 hours, an estimated crowd of 250 people took over the intersection of 24th St and Treat St. A stunt driving event took place in the intersection. As officers attempted to stop the event, people started throwing bottles at them. Approximately 60 officers responded to the area. As officers were coming up with a plan and asking people to leave the area, the crowd began to throw bottles, ignite fireworks, and throw explosive devices at them. The incident commander declared the assembly to be unlawful. Numerous audible announcements using a long-range acoustic device were given to the crowd to disperse. Additional verbal requests and commands were given throughout the event. These tactics were used to help de-escalate the incident. Officers deployed twenty-six (26) 40mm foam baton projectiles during the incident. Projectiles were deployed by officers to defend against serious bodily injury to themselves and other officers. There were no documented injuries as a result of the projectile deployment.

On July 5, 2022, officers responded to an unruly crowd of people who started a large fire in the intersection of 24th St and Harrison St. There were approximately I00 people in the crowd. Participants were drinking alcohol, igniting fireworks, and maintaining the fire by continuing to throw flammable objects into it. Approximately 45 officers responded. The incident commander declared the assembly unlawful. Numerous audible announcements using a long-range acoustic device were given to the crowd to disperse. Additional verbal requests and commands were given throughout the event. These tactics were used to help de-escalate the incident. Officers deployed thirteen (13) 40mm foam baton projectiles duringthe incident. Projectiles were deployed by officers to defend against serious bodily injury to themselves and other officers. There were no documented injuries as a result of the projectile deployment.

On July 4, 2023, officers were deployed to the area of 24th St and Harrison St for the 4th of July. Throughout the evening, there were groups of people in the area of 25th St and Harison St that were igniting fireworks, blocking traffic, and consuming alcohol. At approximately 2130 hours, the group of people grew to approximately 300-400 people. Approximately 80 officers responded. People were in the middle of the street disrupting traffic, lighting fireworks, and consuming alcoholic beverages. Fireworks consisted of large commercial style fireworks that flew high into the sky and over and into buildings as well as exploding on the ground. Explosive devices such as M-80’s and Barrel Bombs also exploded on the ground. The group became unruly and hostile. Stunt driving, bottles being thrown at cars and fighting was reported. The incident commander declared the assembly to be unlawful. Numerous audible announcements using a long-range acoustic device were given to the crowd to disperse. Additional verbal requests and commands were given throughout the event. These tactics were used to help de-escalate the incident. Officers deployed four (4) 40mmfoam baton projectiles during the incident. Projectiles were deployed by officers to defend against serious bodily injury to themselves and other officers. There were no documented injuries as a result of the projectile deployment.

On July 8, 2023, officers were deployed to Dolores Park for the "Hill Bomb" event. The event was unsanctioned and not allowed. Approximately 250 people came to the event and ended up taking over a portion of Dolores St. Approximately 100 officers were deployed to the event. During the event, the crowd became unruly, and an officer was attacked with a sharp object. Bottles, fireworks, and other objects were thrown at officers. The incident commander declared the assembly to be unlawful. Numerous audible announcements using a long-range acoustic device were given to the crowd to disperse. Additional verbal requests and commands were given throughout the event. These tactics were used to help de-escalate the incident. Officers deployed nine (9) 40mm foam baton projectiles during the incident. Projectiles were deployed by officers to defend against serious bodily injury to themselves and other officers. There were no documented injuries as a result of the projectile deployment.
